In arbitration there is no judge or jury, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow these Terms of Service as a court would. Notwithstanding the foregoing, disputes to enjoin infringement or other misuse of intellectual property rights may be brought in a court of competent jurisdiction.

If any lawsuit arises from the Services, pre- or post-arbitration, the action shall be brought before a court of law. User agrees that the sole and proper jurisdiction of any lawsuit shall be in Orange County of the state of California. In the event that litigation is in a federal court, the proper court shall be a federal court in the Central District of the state of California, County of Orange.
User agrees that the applicable law to be applied shall, in all cases, be California law.
Limitations of Cause of Action
